References to “Accurate Body Language,” “ABL,” “Company,” “We,” “Us,” “Our,” “D/B/A” as a Party mean and refer to the parent company(ies), members, officers, directors, employees, subsidiaries, affiliates, licensors, service providers, agents, paid and unpaid entities, and assigns of Accurate Body Language, LLC.

“Parties” mean Accurate Body Language and you. Accurate Body Language and you are each a “Party.”

“You” and “Your” refers to a person who is a guest on this website or a user who has created an Accurate Body Language account.

You may be asked to provide your personal information when you contact or interact with Accurate Body Language or an Accurate Body Language affiliated company. Accurate Body Language and its affiliates may share this personal information with one another and use it consistent with this Privacy Policy. When you create a Accurate Body Language User Account, purchase a product, download a software update, contact, or interact with us, we may collect several types of information from and about users of our website, including your submitted personal information or aggregated, non-personal, demographic information:

Personally Identifiable Information (PII): by which you may be personally identified directly or indirectly, such as name, e-mail address, birthdate, telephone number, credit card information, postal address, billing address, shipping information, contact preferences, or any other identifier by which you may be contacted online or offline. When payment or payment information is required, we will direct you to submit credit card information through a third-party credit card merchant, processing, or billing provider (e.g., Stripe) to successfully complete the payment transaction. 

We may use PII to verify, identify, assist with identification of users, and to determine appropriate services; to send important notices, such as communications about purchases and changes to our terms, conditions and policies; to conduct auditing, data analysis, and research to improve Accurate Body Language products, services, and customer communications.

Accurate Body Language uses PII to respond to your inquiries; provide you with services that you have requested; keep you informed of product announcements, software updates, services, and upcoming events that Accurate Body Language thinks may be of interest to you; and otherwise personalize or enhance your experience with Accurate Body Language. We also use personal information to help us create, develop, operate, deliver, and improve our products, services, content and advertising, and for loss prevention and anti-fraud purposes. 

If you don’t want to be on our mailing list, you can opt out anytime by navigating to the unsubscribe link in the last e-mail you received from Accurate Body Language. You will have the option to unsubscribe from an individual list or from all Accurate Body Language lists.

You are not required to provide the personal information that we have requested, but, if you chose not to do so, in many cases we will not be able to provide you with our products or services or respond to any queries you may have.
Non-Personally Identifiable Information (NPII): is aggregated information such as: demographic information, IP addresses, internet connection, information about the equipment you use to access our website, usage details, user behavior data from web interaction metric tools, business, language, zip code, area code, unique device identifier, referrer URL, time zone of user, and other information that does not reveal your personal information or specific identity.  

We collect NPII: (a) directly from you when you provide it to us; (b) automatically as you navigate through the website (which may include usage details, IP addresses and information collected through cookies, web beacons, and other tracking technologies); and (c) from third parties, for example, our business or affiliate partners.  

Accurate Body Language reserves the right to collect, use, transfer, store, and disclose aggregated NPII about our users without restriction and for any purpose in order to: better understand customer behavior, interests, activities, and usage of our website services; improve our products, services, and advertising; provide more useful information to our customers; to understand which parts of our website, products, and services are of most interest; and to improve the relevancy of results provided by our services.

Information You Provide to Us or that We Collect
PII and NPII may be collected anytime you access or use an Accurate Body Language website, during in-person discussions, visual, auditory, digital, electronic, or written communications. The information we collect on or through our website may include:
 information that you provide by filling in forms on our website, including information provided at the time of registering to use our website, reporting problems with our website, subscribing to our products and services, posting material, or requesting further services; (b) records and copies of your correspondence including email addresses, if you contact us; (c) your responses to surveys that we might ask you to complete for market research or customer service purposes; (d) details of transactions you carry out through our website and of the fulfillment of your orders, including financial information you may be required to provide before placing an order through our website; and (e) your search queries on the website.

You also may provide information to be published or displayed (hereinafter, “posted“) on public areas of the website, or transmitted to other users of the website or third parties (collectively, “user contributions”). Your user contributions are posted on and transmitted to others at your own risk. Additionally, we cannot control the actions of other users of the website with whom you may choose to share your user contributions. Therefore, we cannot and do not guarantee that your user contributions will not be viewed by unauthorized persons.

Automatic Information and Data Collection Technologies
Collecting various types of NPII to help us: make your experience more enjoyable, measure site activity to identify future improvements, and compile aggregate data to help serve site visitors better.  

As you navigate through and interact with our website, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions and patterns, including (a) details of your visits to our website, including traffic data, location data, logs and other communication data and the resources that you access and use on the website; or (b) information about your computer and internet connection, including your IP address, operating system and browser type. Because there is not yet a common understanding of how to interpret web browser-based “Do Not Track” signals other than cookies, we do not currently respond to “Do Not Track” signals that are undefined.

The information we collect automatically is statistical data, but we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our website and to deliver a better and more personalized service by enabling us to (a) estimate our audience size and usage patterns; (b) store information about your preferences, allowing us to customize our website according to your individual interests; (c) speed up your searches; and (d) recognize you when you return to our website.

The technologies we use for this automatic data collection may include cookies, flash cookies, and/or web beacons, described below: cookies (or browser cookies). Web Beacons
Emails and newsletters sent electronically, as well as pages of our website, may contain small electronic files known as web beacons (also referred to as clear gifs. pixel tags and single-pixel gifs) that permit Accurate Body Language, for example, to count users who have visited those pages or opened an e-mail and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

If you visit this site with an open ID (such as Facebook), you may also be sharing and integrating data with third-party social media sites, and we may track aggregate data about the number of visits to this site with an open ID, the number of items “liked” on this site, or items on this site that you choose to share with a third-party social media site. We do not collect personal Information automatically, but we may tie this information to personal information about you that we collect from other sources or you provide to us.

Third-party Use of Cookies and Other Tracking Technologies
Some content or applications, including advertisements, on the website are served by third-parties, including advertisers, ad networks and servers, content providers and application providers. These third parties may use cookies, alone or in conjunction with web beacons or other tracking technologies, to collect information about you when you use our website. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based, behavioral, advertising or other targeted content.

We do not control and are not liable for the actions of any third parties who we may promote. We pride ourselves in working with quality companies, but have no control over the actions of those third parties. While we are not liable for any of the actions of those third parties, you should feel free to give us feedback from time to time on your experiences with any third parties to whom we work with so that we may enhance our future service to all customers. How We Use Your Information

By submitting your email address on the website, you agree to receive email from Accurate Body Language and its websites. You can cancel your participation in any of these email lists at any time by clicking the opt-out link or other unsubscribe option that is included in the respective email. We only send emails to people who have authorized us to contact them, either directly, or through a third party. We do not send unsolicited commercial emails, because we hate spam as much as you do.

In addition, you agree that by submitting your telephone contact information on the website and/or registering to receive the product and/or service offered herein, such act constitutes a purchase, an inquiry, and/or an application for the purposes of the Amended Telemarketing Sales Rule (ATSR), 16 CFR ‘310 et seq. and any applicable state and local “do not call” regulations. We retain the right to contact you via telemarketing in accordance with the ATSR and the applicable state regulations.

Disclosure of Your Information

Accurate Body Language does not sell or lease PII about you to others. Accurate Body Language may share PII with our affiliates and third parties contracting with us to provide relevant services to you. Accurate Body Language reserves the right to disclose or use your PII when you have expressly requested us to do so, or if we believe it is necessary to: (a) to comply with any court order, subpoena, law or legal process, including to respond to any government or regulatory request; (b) to enforce or apply our Terms of Use and other agreements, including for billing and collection purposes; or (c) if we believe disclosure is necessary or appropriate to protect the rights, property, safety, or operations of Accurate Body Language, our customers or others (this includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction). We may disclose aggregated information about our users, and information that does not identify any individual, without restriction and for any purpose.  

Except as otherwise stated herein, we will not share your personally identifiable information with third parties unless you have given us explicit permission to do so, such as in order to fulfill a third party offer that you have accepted from us. However, by permitting us to collect this information, you will be able to receive information on other products and services that may be of interest to you, including related third party offers that we may send directly to you. You also enable us to personalize your experience with us so that we can provide you with the highest quality of service.

By participating in our subscription or membership program(s) through the website, you agree and understand that other members of the program may see the comments, questions, photos, and/or other documents that you post on the membership website, as well as any responses to you that are posted by Accurate Body Language or other members. If you do not want your personal details revealed to other members of the program, then please do not post any such information through the subscription or membership website.

Accurate Body Language disclaims any responsibility for the accuracy or content of information found on third party websites that link to or are linked from any Accurate Body Language website. Accurate Body Language disclaims any responsibility for the security of any information (including without limitation credit card and personally identifiable information) that you may provide to any third party. Accurate Body Language reserves the right, at any time and in its sole and absolute discretion, to block links to any Accurate Body Language-maintained website through technological or other means without prior notice.

As a Accurate Body Language website user, you will be required to create an account with Accurate Body Language. You warrant that the information you provide Accurate Body Language is truthful and accurate and that you are not impersonating another person. You are responsible for maintaining the confidentiality of any password you may use to access your Accurate Body Language account, and you agree not to transfer your password or user name, or lend or otherwise transfer your use of or access to your account, to any third party. You are fully responsible for all transactions with, and information conveyed to, Accurate Body Language under your account. You grant Accurate Body Language permission to use any and all photographs, or video, audio, or digital recordings, taken by Accurate Body Language, its agents, or employees, or submitted by you to Accurate Body Language as well as all written endorsements of Accurate Body Language that you send to us, or that you post on social media (e.g., social media posts, texts, and messages sent to Accurate Body Language are hereinafter referred to as “Photographs”) in any media (including print, book publication, internet, social media, film, television and no matter how distributed or published) for any purpose, which may include, but shall not be limited to, advertising, promotion, marketing, marketing research, and packaging of Accurate Body Language or any product or service sold and marketed by Accurate Body Language. You agree that this authorization to use Photographs may be assigned by Accurate Body Language to any other party. You agree that that the Photographs may be combined with other Photographs, sounds, text and graphics, and that the Photographs may be manipulated, cropped, altered or modified in the sole discretion of Accurate Body Language. You agree not to charge a royalty or fee, and not to make any other monetary assessment against Accurate Body Language in exchange for this Release and Assignment. You hereby release and forever discharge Accurate Body Language from any and all liability and from any potential damages you may or may not suffer as a result of the use of the Photographs. You further acknowledge and agree that this Release is binding upon your heirs and assigns and is irrevocable.

California Privacy Rights 
If you live in the State of California, please check California privacy rights or consult a properly licensed attorney. Under the California Civil Code, if you are a California resident you have the right to request that companies who conduct business in California provide you with a list of all third parties to which the company has disclosed personal information during the preceding year for direct marketing purposes. 

Alternatively, the law provides that if a company has a Privacy Policy that gives either an opt-out (often referred to as “Unsubscribe”) or opt-in choice for use of your personal information by third parties (such as advertisers or affiliated companies) for marketing purposes, that the company may instead provide you with information on how to exercise your disclosure choice options.

This site qualifies for the alternative option; it has a comprehensive Privacy Policy and provides you with details on how you may either opt-out or opt-in to the use of your personal information by third parties for direct marketing purposes.
